It is understood that the present draft consists of 15 chapters 132, followed by chapters: General Provisions, energy management, energy strategy and planning, energy exploitation and processing, transportation, energy supply and services, energy conservation, energy reserves, energy emergency, rural energy, financial and tax incentive and restraint, energy science operation of foreign law than nearly slightly.
The expert also disclosed that 200 copies of the draft distributed to the provincial government, to participate in an "energy law" drafting group of 15 central units, various national energy industry associations and large energy enterprises, and will soon be released to the community by for comments.
According to China's law in the legislative process, the State Council has the power to formulate administrative regulations, and then the State Council to the National People's Congress or its Standing Committee to the legal case, and later by the NPC or its Standing Committee to vote and adopted. The current "Energy Act" the legislative work is still in the stage of drafting the State Council system, and put into law from many procedures to go.
However, the formation of a law is not only prepared to succeed, there is still a long behind some way to go. Facing regulatory tests
It is understood that the "Energy Act" (draft) has attracted the most attention is the second chapter - "energy management." The section explicitly stipulates government departments at all levels and departments in charge of the energy sector and the Association of duties and coordination mechanisms, energy regulatory body functions, energy trade associations, and public participation in energy policy-making, and so forth. Set up a "Department of Energy" as a department in charge of managing the energy field to become the consensus of all circles.
As China's long-term lack of efficient energy policy, and industries are fragmented, in their own interests and the overall energy market lack of co-ordination arrangements, the co-ordination between departments is the legislative difficulties. But it was just the energy industry in national development occupies a pivotal role, reasonable distribution of resources and efficient management can benefit their countries.
